Abstract

Interfaith marriage has become a topic of
interest in social and cultural studies, especially
in countries with significant religious diversity.
This article aims to investigate the dynamics of
interfaith marriage law in Indonesia, including
the challenges faced and future prospects. In
addition, this article will also compare the
practice of interfaith marriage law in Indonesia
with the legal practice in Turkey, as a country
with a similar background in the context of a
multicultural society and a majority Muslim
population. This study uses a doctrinal
research method with a comparative approach.
The researcher also uses document studies or
library materials such as legal journals, books,
and Legislation, namely Law Number 1 of 1974
concerning Marriage, Constitutional Court
Decision Number 24/PUU-XX/2022 and
Supreme Court Circular Letter No. 2 of 2023
concerning Guidelines for Judges in
Adjudicating Cases of Applications for
Registration of Marriages Between People of
Different Religions and Beliefs, The Turkish
Family Law of Cyprus of 1951 and Turkish
Civil Code No. 4721. This study shows that the
Decision of the Constitutional Court Number
24/PUU-XX/2022 and the Circular of the
Supreme Court No. 2 of 2023 concerning
Guidelines for Judges in Adjudicating Cases of
Applications for Registration of Marriages
Between People of Different Religions and
Beliefs prohibit the implementation of
interfaith marriages absolutely and ignore
religious interpretations that allow interfaith
marriages and only refer to the majority
religious interpretation. Indonesia and Turkey

present interesting legal arrangements and
have significant differences in the context of
marriage and interfaith marriages. According
to Turkish Marriage Law, religion and belief
are not obstacles to the implementation of a
marriage. With a deeper understanding of the
comparison between Indonesia and Turkey, it
is hoped that it can provide new insights
regarding more inclusive and comprehensive
policies regarding interfaith marriages in
Indonesia
